Check for injuries, call 911, document the scene, and see a doctor even when you feel fine. These four actions protect your health and your right to compensation after a rear-end crash. Understanding what to do when you get rear-ended separates drivers who receive fair compensation from those who settle for far less.
At the Monsour Law Firm, we handle car accident cases across Tyler, TX, every day, and the clients who act quickly and correctly after a collision consistently see better outcomes. A car accident lawyer in Tyler, TX, can guide you through every step, but the actions you take on your own in those first moments matter just as much.
The first thing to do when you get rear-ended is check yourself and any passengers for injuries. Pain does not always appear immediately. Adrenaline kicks in fast after a crash and often covers up real pain. Whiplash, muscle injuries, and ligament damage frequently take hours or even days to surface.
After checking for injuries, move your vehicle off the road if it is still drivable. Activate your hazard lights and wait for assistance from a safe location, such as behind a guardrail or on a sidewalk. Avoid standing in the road, as rear-end collisions on busy Tyler streets frequently lead to dangerous secondary crashes.
Calling 911 after a rear-end collision, even a minor one, creates an official record of the crash that protects you throughout the claims process. Under Texas Transportation Code Section 550.062, a law enforcement officer who investigates a motor vehicle collision must file a written report when the crash results in injury, death, or property damage of $1,000 or more, and that report must reach the state within 10 days.
These reports serve as critical evidence for insurance claims and legal proceedings. Without official documentation, you lack a factual counter-narrative if the other driver disputes the events.
What you collect at the scene can determine how far your car accident claim goes. According to the Texas Department of Insurance, drivers should photograph all vehicles involved, capture license plates and visible damage, speak with witnesses, and write down the location, time, weather conditions, and exactly how the crash happened, step by step. Collect the following from the other driver:
If bystanders witnessed the rear-end accident, ask for their names and phone numbers before anyone leaves. Witness accounts often prove valuable when the other driver disputes who caused the accident. The more thorough your documentation, the stronger your car accident claim.
Notify your insurer about the rear-end crash promptly, but keep details brief. Consulting a car accident attorney first helps protect your rights and prevents statements that could damage your claim. Stick to basic facts like time and location, avoiding opinions on fault or injury specifics, as adjusters look for reasons to minimize payouts.
Never accept a settlement offer before knowing the full picture of your injuries and repair costs. Rear-end collision injuries often require weeks or months of treatment, and an early check rarely accounts for what comes next. Have an attorney look over any offer before you sign anything.
Handling a car accident claim without legal support leaves most people unprepared to fight for what they deserve. Insurance companies have adjusters whose entire job focuses on paying out as little as possible.
An attorney investigates the crash, gathers evidence, and negotiates with insurers for you. Knowing when to seek professional help is essential after being rear-ended. Prompt action preserves fresh evidence, while skilled legal representation is vital if your case requires court intervention for fair compensation.
