If you were hurt and it was someone else’s fault, there’s a lot to deal with. When you’re flooded with pain, confusion, frustration and conflicting information, it’s hard to know what the weeks and months ahead will bring. You may be asking, “how do I know if I have a personal injury lawsuit? Do I have a personal injury case?”
The best way to find out is to schedule a free consultation with Monsour Law Firm personal injury attorneys. We can talk over your specific information and give you immediate access to advice from legal experts. Then, we can handle the personal injury case details while you concentrate on healing from your injuries and getting your life back.
A Personal Injury Case Meets These Requirements
In order to file a personal injury case and receive a settlement, the injured party or their immediate family must meet three basic requirements. You’ll need to present evidence to support the following:
Someone was negligent. They failed to take a reasonable amount of care and it caused damage or injury to someone else. They did something they knew they shouldn’t, or they didn’t take reasonable precautions. A driver who runs a stop sign, a property owner who knowingly leaves rotten steps in place or a business owner who doesn’t put out wet floor signs are all negligent.
Their negligence caused your injury. In the above examples the driver who ran the stop sign might have caused an accident that broke your arm. The property owner’s rotten step might have injured a neighbor who stopped by. The wet floor might have led to a customer slip and fall injury. In each case, a successful personal injury claim would need to connect the negligence to the injury.
The injury caused harm for which there should be compensation. In each of the examples we’ve given, the victim might have needed medical care that created documentation of the injury, but that also costs money. There might also be non-monetary losses or the need for punitive damages.
When Personal Injury Rules Apply
We have a long track record of representing clients in a number of situations. Here are some of the areas in which we specialize.
Motor Vehicle Accidents
Monsour Law Firm attorneys have handled thousands of car accident cases. Our goal in each one is to help our clients receive the highest amount of compensation available and use every resource available to live with as much fulfillment as possible.
18-Wheeler Accidents
The size and weight difference means this type of accident is often more severe and more likely to be fatal. The defendant is typically highly motivated to protect their best interests, so you need someone on your side. We can help.
Dangerous Drugs
We represent clients who have been injured by dangerous drugs like Pradaxa, Xeljanz and Zantac. We also provide support and representation for clients who have tragically lost family members because of dangerous drugs.
Oilfield Injuries
Our part of the country employs large numbers of workers in oil and gas. Those jobs are dangerous, and sometimes workers are injured or killed because another employee or their organization was negligent. We listen, assess, analyze and work to get you maximum compensation.
Defective Products
Sometimes you’re sold goods that cause harm and the manufacturer knew better, but they sold it anyway. We represent clients who have been injured by JUUL, IVC filters, 3M Combat Ear Plugs, Roundup and other defective products.
